Charles Gall has broad commercial and litigation experience with an emphasis in construction law, environmental law, and the representation of lenders and fiduciaries. He represents sureties, public and private owners, general contractors, subcontractors, architects, design professionals, lenders and material suppliers. His experience includes litigation, arbitration and mediation of delay and impact claims, claims for defective design and construction, differing site conditions claims, and mechanic’s lien claims.  Mr. Gall also represents clients before the Department of Commerce and Consumer Affairs, other State and County Agencies and the Contractor's License Board on licensing issues.

Mr. Gall's expertise includes the drafting and negotiation of Private and Public Construction Contracts.  Representative examples include the construction contracts for the 352-unit Keola La’i Condominium and the 462-unit Trump International Hotel and Tower.

 

Mr. Gall's Environmental Law practice includes representation of clients in a broad spectrum of environmental litigation, consultation and regulatory matters. He has handled cases involving violations of the Clean Water Act, cost recovery under CERCLA, releases from and closures of underground storage tanks, due diligence investigation of properties for environmental contamination, and toxic tort cases. Mr. Gall has also assisted clients with entry into the State of Hawaii Voluntary Response Program.

 

Mr. Gall represents corporate and individual fiduciaries in breach of fiduciary duty cases and in other trust and estate litigation.  He also represents local and national lenders in lender liability cases and environmental matters.
Mr. Gall served as local due diligence counsel for lenders on 4 major alternative energy projects with aggregate financing in excess of $750 million.  The representation included review and analysis of all project documentation including construction contracts, environmental and archeological studies, building and environmental permits and the real estate and conveyance documents.

Education

While in law school, Mr. Gall served as an Editor and Legislative Review Staff Writer of the Pacific Law Journal. He was elected to the Traynor Honor Society and also received the American Jurisprudence Award in Advanced Torts.

Prior Employment

Mr. Gall served as Chief Administrative Officer and General Counsel for Construction Management and Development, Inc. (CM&D) an international project and construction management firm headquartered in Honolulu with offices across the United States, in Asia and Central America. During that time, Mr. Gall also served as a member of CM&D's Board of Directors. While at CM&D, Mr. Gall was responsible for overall administration of the company and its foreign and domestic subsidiaries. As General Counsel, Mr. Gall had full responsibility for all legal matters for the company and its subsidiaries. He gained considerable experience in managing outside counsel on a variety of litigation and corporate matters in both the United States and in foreign countries.

Mr. Gall has been recognized nationally as one of the Best Lawyers in America and also by Honolulu Magazine as one of Hawaii’s Best Lawyers in the practice areas of Construction Law and Construction Litigation.

Professional Associations and Licenses

Mr. Gall is a member of the Hawaii State Bar Association, the American Bar Association, the Forum on the Construction Industry and the Association of Trial Lawyers of America. Mr. Gall is licensed to practice before all the State and Federal Courts in the State of Hawaii, the United States Supreme Court and the United States Court of Claims.

Mr. Gall was appointed to the Honolulu Ethics Commission in 2010 and served as the Chair of the Commission.
