Jonathan S. Moore is a partner in the firm who concentrates his practice in commercial litigation, and has represented both the government and private contractors in HRS Chapter 103D procurement hearings and subsequent appeals.  Mr. Moore has also represented developers, financial institutions and major manufacturers in environmental compliance matters, regulatory and zoning issues, and contractual disputes.

Education

Mr. Moore graduated magna cum laude from Tulane Law School in New Orleans, Louisiana in 2007.  He was a member of the Moot Court Board, and was inducted into the Order of the Coif.  While in law school, Mr. Moore received CALI Excellence for the Future Awards in American Common Law Property, International Environmental Law, and Toxic Tort Litigation Practice.  In his upper-level Contracts seminar, Mr. Moore’s paper on the use of mathematical formal methods in software development contracts was selected as the best in the class.

Prior Employment

Before entering law school, Mr. Moore lived for three years in Hsinchu, Taiwan, where he studied Mandarin Chinese, taught kindergarten and elementary school, and owned a Mexican restaurant.

Professional Associations and Licenses

Mr. Moore is a member of the Hawaii State Bar Association and the American Bar Association.  He is admitted to practice before all state courts in the State of Hawaii, the United States District Court for the District of Hawaii, and the United States Court of Appeals for the Ninth Circuit in San Francisco, California.

Representative cases in which Mr. Moore has assisted as counsel include:

  • Robert’s Tours and Transportation, Inc. v. Dept. of Finance, County of Maui, PCX 2010-8 (DCCA 2010) (summary judgment for petitioner finding that County’s request for proposals for paratransit services was covered by HRS Chapter 103D in spite of County’s characterization of contract as an exempt grant).
  • Bombardier Transportation v. City and County of Honolulu, PCX-2011-4 (DCCA 2011) (summary judgment for City and County of Honolulu finding that City properly rejected Bombardier’s RFP response for Honolulu rail project as nonresponsive).

  • Sumitomo Corporation v. City and County of Honolulu, PCX-2011-005 (DCCA 2011) (judgment for City and County of Honolulu, after four day evidentiary hearing, finding that City properly awarded largest procurement contract in state history and properly rejected Sumitomo’s bid protest)
  • Robert’s Hawaii School Bus, Inc. v. Hawaii Dept. of Education, PCX-2012-006 (summary judgment for Robert’s Hawaii School Bus, finding that DOE improperly awarded school bus services contract to higher bidder and ordering DOE to cancel contract award and award to Robert’s Hawaii School Bus).
  • Ko Olina Development, LLC v. Centex Homes, Civ. No. 09-00272 DAE/LEK, slip op. (D. Haw. Oct. 29, 2010) 2010WL4397048 (four day non-jury trial before Judge David Alan Ezra, finding in favor of defendant Centex Homes on primary issue involving contractual rights to limited common elements in condominium resort development in West Oahu.
  • Ko Olina Development LLC v. Centex Homes, Civ. No. 09-00272 DAE/LEK, slip op. (D. Haw. March 29, 2011) 2011WL1235548 (award of $499,993.94 in attorneys’ fees and $26,435.74 in costs following trial award in favor of Defendant Centex Homes on primary issue in contract litigation).
  • White v. IndyMac Bank, FSB, et al., Civ. No. 09-00571 DAE-KSC, slip op. (D. Haw. March 20, 2012) (summary judgment in favor of defendant mortgage servicer OneWest Bank, FSB on all claims in mortgagor’s complaint alleging unfair business practices in violation of HRS Chapter 480).
